Terms & Conditions

“Us”, “we”, “our” or “The Castle”, “Online Shop” or “the site” when mentioned within these Terms and Conditions will refer to the Castle Climbing Centre and its parent company High Performance Sports Limited (a UK Registered Limited Company Number 02839366 VAT Registration Number GB 629 0463 38) located at The Castle Climbing Centre, Green Lanes, London, N4 2HA. These Terms govern the agreement (also called a contract) between us if you use the site and/ or buy products from the Online Shop. If you access or use the Online Shop we will take that to mean that you agree to the Terms.  If you make a purchase from the Online Shop, you accept the Terms.  In both cases, these Terms are binding on you. If you don't agree, please refrain from using the Online Shop. Any changes to the Terms may be made and a revision date will be included at the end of this page. By using the Online Shop after we’ve changed the Terms, you agree to the new Terms.  

Using the Online Shop 
The Castle Climbing Centre Online Shop is an extension of the Castle Climbing Centre Shop based at The Castle Climbing Centre, Green Lanes, London, N4 2HA. Website users must be 18 years or older and purchase items using your own identity and payments should be made under your own name. We have the right to end our agreement with you for your use of the Online Shop if you breach these Terms or if we suspect you have breached these terms or are engaged, or are about to be engaged or have been involved in fraudulent or illegal activity in connection with the Online Shop or on the site.  

Payment  
You may purchase products from the Online Shop with the following credit cards: Visa, MasterCard, American Express and Visa Electron.  All purchases will be charged to your nominated card upon submission of your order. All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non- delivery. We are sorry that we cannot accept PayPal, personal cheques, cashier’s cheques, money orders or direct deposits.

Delivery & Click+Collect 
We accept orders in the UK. We do not accept orders from overseas. Please ensure your delivery address is correct. By making a purchase, you agree that you accept the shipping charges that have been notified to you. Delivery is available to mainland Great Britain only (England, Scotland and Wales). If you select delivery your purchased products will be sent to you by UPS courier service (or an alternative courier service at our discretion). Deliveries will be made at least once a week but due to COVID-19 it may take up to 7 days for your order to arrive due to delays to shipping services. We do not offer express delivery services.  
Click+Collect orders will be held on the Castle premises for 3 weeks after the date of purchase. Uncollected orders after 3 weeks will be assumed unwanted. We will refund the cost of uncollected items using the original method of payment and the items will be relisted for sale.  

Exchanges and Refunds 
We do not currently offer exchanges. If you wish to exchange an item, for instance a different size t-shirt, please follow the returns policy below and your account will be credited, and you may place a new order on our site for the new item.
Returns and refunds will be managed on a case by case basis, so depending on the circumstances, they can take a variable amount of time to process. Where refunds are granted, payments will be initiated within a business day. Please be aware that these payments can take up to 5 business days to process and appear on your bank statement. See our Returns Policy below for more information regarding processing returns and refunds.
Please note: climbing hardware and safety equipment such as harnesses, quickdraws, ropes, slings, belay devices, carabiners, nuts, cams etc are non-returnable unless defective. 

Returns Policy
To request a refund on eligible products (I.e. not climbing hardware which is non-returnable unless faulty) you must contact shop@castle-climbing.co.uk within the 14 days from the date you receive your order. Return postage for refunds is at the buyer's expense unless restricted by mandatory consumer law (e.g. if you have received the wrong product). If you wish to return items, in order to receive a refund the items must be returned in a suitable condition so as to be resold as new. The product must show no signs of use, and all original packing including tags must be undamaged and unaltered. Climbing shoes must be unworn and in their original condition and packaging. Signs of wear including but not limited to discoloration and scuffs on rubber soles will be seen as use and shoes will not be elligible for return. If a product is not returned in a suitable condition, we reserve the right to not issue a refund.

Defective or damaged products
If your purchase is in any way defective, damaged or not as described in the product’s description page of the Online Shop, please contact us as soon as possible with your proof of purchase, and we will arrange for a replacement product or refund where necessary. Returned items of Personal Protective Equipment such as belay devices or harnesses will be checked by a member of the Castle Shop team to ensure they are defective. Items that have been obviously used or tampered will not be refunded. The Castle Shop does not offer a warranty on purchases. You should contact the manufacturing company for a warranty claim.   

Disclaimer and limitation of liability
We use reasonable care and skill to ensure the accuracy of the information we provide through the Online Shop and in all products purchased through the Online Shop. However, we do not accept liability (except as set out below) for any errors/ omissions in our Shop and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice. Except as provided by law, we cannot guarantee that the online shop or products purchased through the online shop will be 100% accurate or up to date.  The information in the online shop or products purchased through the online shop is general and may not be suitable for your particular needs.  You should verify critical information (such as advice about health and safety and proper use of climbing hardware including fit of climbing equipment such as shoes or harnesses) independently before you climb using your own risk assessments.  You acknowledge that you use the online shop and all products purchased through the online shop at your own risk. Except as provided by law, the online shop and all products purchased through the online shop are provided 'as is' and “as available” and without any warranty or representation, express or implied.  To the maximum extent permitted by law, we exclude all implied representations and warranties (including, for the avoidance of doubt, those in relation to merchantability and fitness for a particular purpose) which, but for the terms, might apply in relation to your use of the online shop or of products purchased through the online shop.     

We are not responsible for:  
Loss that was not reasonably foreseeable;  
Loss that was not caused by our breach of contract or by our negligence;  
Indirect or secondary loss that arises from any breach by us;  
Losses that relate to a business, such as lost data, lost profits or business interruption, that you or a third person is engaged in;  
Losses caused by any inacuracy in the information you provide to us, such as delivery or payment information; or  
Any increase in loss that was caused by your breach of contract or your negligence.  

You must take all reasonable steps to minimize the extent of any loss you may suffer as a result of your use of the Online Shop or any products purchased through the Online Shop.  We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of god, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.  Our maximum liability to you in relation to your use of the Online Shop is the amount paid by you for the item that is the subject of the claim.  Nothing in these Terms shall seek to exclude or limit liability for death or personal injury resulting from our negligence or that of our servants, agents or employees or for any liability that cannot by applicable law be excluded or limited. 

Privacy Statement - Shop Purchases
When purchasing from the Online Shop, you will need to supply us with your personal information, such as your name, email and delivery address in order to purchase products. We collect and use your personal information to fulfil your order and deliver it to you. We will not pass your details on to third parties.  

Privacy Policy – The Castle Climbing Centre
If you choose to subscribe to the Castle newsletter you will receive approximately monthly updates about the whole of the Castle, not exclusively the Online Shop. Privacy Policy 
This Privacy Policy governs the manner in which The Castle Climbing Centre collects, uses, maintains and discloses information collected from users (each, a "User") of the shop.castle-climbing.co.uk website ("Site"). This privacy policy applies to the Site and all products and services offered by The Castle Climbing Centre.  

Personal identification information 
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, place an order and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, credit card information. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.  

Non-personal identification information 
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information. Web browser cookies Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.  

How we use collected information 
The Castle Climbing Centre collects and uses Users' personal information for the following purposes:  
- To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs.  
- To personalize user experience.
-We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site. 
- To improve our Site. We continually strive to improve our website offerings based on the information and feedback we receive from you. 
- To process transactions. We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
- To administer a content, promotion, survey or other Site feature.
- To send Users information they agreed to receive about topics we think will be of interest to them.
- To send periodic emails. The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions. 

If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

How we protect your information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures. Our Site is also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. 

Sharing your personal information
We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

The Castle Climbing Centre has the discretion to update this privacy policy at any time. When we do, the date at the bottom of this page will be updated. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications. 

Your acceptance of these terms
By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
